What happens if you cosigned for a spouse and then you get divorced? [disablity] [nih]


My brother a few years ago signed cooperation for his wife so she could get a credit card (it is not working and Disablity) with their local credit union (NIH credit union, he worked for NIH and is a member of the club with him)
The account is not a joint account, and he is not listed on the card as an authorized user. I told him he should immediately either try to remove her name from a common cards, they closed as AU-cards or cards where he can not remove her.
But, in the case of where he cosigned they could get the card in her name only, does he have a refuge, if they decide to keep it open?
He do not want a divorce, but because she has something very, very stupid it was submitted. What would you recommend on cooperation signed card? Is he stuck and hoping she is responsible? I am good friends with his wife to see irresponsible and can not with the card, after all his under her name and her credit and she is very high on stuff.
Is he stuck unless they decide to close?

Reply:I am having difficulty imagining how he would "co-sign" for a credit card account. I mean, if the approval relied on his credit, he would be either the Primary cardholder or the Joint cardholder. In either case, the card should definitely be reporting to his credit already.
Unless the CU required him to sign some kind of personal guarantee for any credit she was granted, it sounds to me as if he sponsored her as a member of the CU and (perhaps) nothing more. In that case, I don't think he is on the hook.
I sponsored my DW as a member of NFCU but her cc's were issued based on her own credit and have nothing to do with me.

Reply:Generally, if he co-signed, he is jointly responsible. Issues such as debts and financial obligations would be addressed in the divorce decree.
I am not an expert, so someone will correct me if I am wrong.

to get my USAA car loan, then later bank account; my ex (navy), called up and asked about his "fiancee" (we were nowhere near close marriage, but he thought it would work, and did) getting a car loan.
they congratulated us, asked our wedding date; pulled my credit and approved me.
he WAS NOT on my loan or my banking info, he was simply a 'sponsor' for me to get "in"
if thats the same case; no worries. i later called to do something (i dont remember) they asked how the wedding was; i had said we broke up…and my account is still intact.

Wow, thanks for the reply. Now that I know I kind of wish I hadn't asked. I thought it was something like that or he didn't take the garbage out or wash the dishes or something.
Maybe she can pay for the marriage counseling with the card..! Divorce does suck I agree, but sometimes everyone is better off as a result.
In my opinion he MUST contact the CU and find out the status of this card and determine exactly the ramifications of his signing for it. It could be in her name only on the card and still be a joint account or even an authorized user.
He needs to find out though and while he's at it, advise him to obtain three hard copies "snail mailed" from each CRA.

There really isn't any way to determine if he's "stuck"until it's determined what her status is and whether or not he's on the hook. If I were him I would immediately contact the CU and inquire with them.
Fill us in on what he did that was very, very, stupid and caused her to want a divorce. Maybe some of us here can avoid the same predicament, c'mon inquiring minds want to know.

Reply:But he is not "on" the account. Its not joint. He co-signed with NIH so she could get an individual account.

Bankrupcy and Sole Prop. [mechanic work] [business assets]


Hello,
I'm just trying to figure out what my business assets are considered in a Ch7 BK – for a Sole Prop. in Florida.
Are they considered Tools of the Trade and exempted? I have a Computer 3 years old), Printer, Monitor, All-In-One, desk (more or less everything computer related). I use this computer for at least 85% business related usage.
Also, my husband has about $250 in tools that he uses for mechanic work – for side work (at least once a month – and barely makes anything on it) every once in a while (nothing registered by the state – just under his name, etc).
Would those be considered tools of the trade (since it brings in a little bit of income, etc).
Also.. the car… we just bought a car for $3200 in January (solely paid for), that's exempted correct? As its our only car (and my husband's only way to work – and my only way to get my kids to Dr's , etc).
Also… does getting a substantial income tax return (that we usually buy stuff that we can't afford during the year (like the car), can we still file CH7? Or would we have to file CH13? Besides our income tax, we don't have much of any $$ during the year. I doubt we would be able to pay anything monthly (as we only have $1450 take home most months), etc.
I wanted to make sure about stuff before I attempted to file (both my husband and I would file)

If so, just about everything we have would be worth under $2000 (besides the "new" car we just bought).
Would you think, based on an income of around $1450/month (take home), that they would just brush off any "assets" ?
Most of the time we don't have $5 left over after everything is paid for (we can't even afford debt consolidation).
I'd seek a lawyer if I could afford one.

If you only have a few minor assets that aren't exempted, possibly as the equity in the car, often the trustee will abandon them anyway as the time and effort to sell them aren't worth the return.

Car loan appearing twice on credit report? [late payments] [repo]


Hello – newbie here.
I have a car loan on my credit report. A few years ago I was with difficulty, and several late payments (30-60 days). The car was never repo'd but the account was closed due to refinancing, but are funded and closed the account and the account on all my credit cards reports.
My question – should this be so? If not, how do I fix it?

Some questions about Pioneer Recovery [repayment agreement] [creditor]


Background: Almost three years ago I had a large credit card account go delinquent. I worked out a repayment agreement and agreed to a monthly payment to be taken out of my checking account each month automatically by the creditor. I did pretty good but was not perfect. About a year ago, the account got to 120 days late. Since then I have been perfect in making my payments. For some reason, without calling or writing, they failed to take the August payment out of my account as agreed. The next day they charged it off. On September 7, they called and I worked out a settlement with their Recovery department. They were to take out the first payment on the settlement this Friday.
Update: Last night I got a call from Portfolio Recovery saying they had purchased the debt from the CC company on September 8, the day after my settlement agreement with the OC, and knew nothing of a settlement. I just listened and said I had to research the issue. I pulled my credit report this morning and they pulled a hard inquiry yesterday but are not reporting the account yet. The CSR said they would not report it. The OC is now reporting a $0 balance, charge off.
I know that I need to immediately do a DV to Portfolio. I have not yet received a letter from them but they said they mailed one last Friday. And, I plan on calling the OC and finding out what happened to our agreement. And it will be recorded.
Now some questions:
1. Why would the OC sell it to a CA after working out a settlement agreement?
2. Does Portfolio report to the CRA's on accounts they purchased?
3. Since this was sold within a week or so of chargeoff, is this a typical deal where the CA paid pennies on the dollar, or do they have real money invested? If so, any idea how much? Any guesses?
4. Why would the OC sell the debt this quickly without trying to get a CA to collect on a commission first?
5. Can I expect Portfolio to validate, ignore my request, or send it on to another CA? Or, will they sue?
6. Assuming that they can validate, any ideas what I can reasonably expect to settle with them for?

they probably paid 10 cents on the dollar or thereabouts
you've GOT to go to radio shack and buy a phone recorder (if legal in your state)…ANYTHING they say on the phone NEVER HAPPENED…unless YOU can prove it

Reply:BOA/MBNA said they noted the settlement agreement in the file, but the CSR failed to set up the payments in the system. So it was their fault that it was sent to the collection agency. I am waiting for a call back from the CSR to see what happened. BOA/MBNA did say it was sold to Portfolio Recovery.
So, does anyone have any answers to the questions I originally posted on what I can expect from Portfolio? I figure the DV will buy me some time, but I need some idea what to expect. And, in these circumstances, is this an instance of them buying a recent chargeoff for a reasonable price, or is it the purchase of a junk debt for pennies on the dollar?
BOA/MBNA just called back and said the payments were in the system and the account should not have been sold to Portfolio. He will have a manager call me after 12.

Homeowner's Insurance: What Do I Need To Do? [insurance provider] [renters insurance]


Since I already approved and cleared to close . what should I have to take care of as far as homeowners insurance? Or is that done by the lender.
I know my Loan Officer requested information on my current insurance, State Farm is, I have renters insurance through them.


Best Answer: You are not required to have insurance on any property. The reason everybody thinks you are required is no bank will ever lend on a property unless you have insurance.

However, you should always have insurance on any property. This is especially true on rental properties. Your scenarios of a fire, death etc can reasonably happen. Whether it is your fault or not you will have the cost to defend yourself so the insurance is worth the cost for defense. You will also want to rebuild which you will need the insurance monies for.

I own rental property and i had a tenant slip and fall on my property. It was total BS but everyone has their right to sue. The tenant sued for a living and had four other similar cases pending. Three years later and 30K in legal bills the case was settled against my wishes. The insurance company paid the tenant 10K to go away. I still had the headache of dealing with the lawsuit and had to pay my deductable of dollarsignr2,500. I figure it cost me dollarsignr10,000 between my time and deductable. Without insurance it would have been dollarsignr40K minimum and probably more.

Reply:I would think that if you go with a company that you already have renters or car insurance with, they wouldn't need to pull your credit, assuming that you have a good pay history with them. I have direct payments with State Farm, so hopefully credit shouldn't be an issue.

1) We don't want them to run our credit if it will increase the number of inquiries, thus lowering our score. Is this a possibility? So far, we've had our credit run only twice since starting the home buying process, both times by the mortgage broker. (We should be closing escrow on May 19th.)
2) Can you recommend some reliable and inexpensive companies to use for our Homeowner's Insurance? We have renter's insurance with State Farm now and I know that they offer a discount if we use them for our car insurance and Homeowner's Insurance.
Any advice in this area is much appreciated!

We went with Allstate (reliable) having our auto insurance with them which led to a nice discount too. We weren't too worried if they pull credit (not sure if they even did).

Reply:Thanks for the advice! I'm suprised my lender hasn't informed me of what they need by closing in regards to insurance.

Reply:One detail you might want to check is whether your lender requires a binder or an actual policy at the closing. A binder is a simple document that the company sends out promising to issue ("bind") coverage, with the actual policy to follow later. The policy is the whole thing- all the fine print. For one house I bought, the lender specifically said they wanted the policy. I told this to the agent about 10 times and 2 days before the closing they delivered- a binder. I got the policy issued in time, but it's just one of those details you have to look out for.
Another detail- make sure coverage is at least the amount the lender requires (generally the amount of the mortgage) and that the lender is listed on the Loss Payee clause. Check with the lender to see exactly how their company name should be worded in the Loss Payee Clause (typically something like, "XYZ Loan Company, its Successors and Sssigns") and give that info to your insurance agent.

Opinions needed for online BK sites [filing chapter 7] [baddies]


Hi all. Im glad I found this place and have been doing a lot of reading. My wife and I are torn between trying to repair our credit ourselves or filing chapter 7. We have a bunch of baddies from where we were out of work and i don't know if we could make much headway trying to remove some of them. Some are debts more than $15,000 where she had vehicles repo'd.
Anyways…..We were looking at a couple of BK sites online…..USA BK and Easy BK services. Was just wondering if anyone has any experience with these? We have a pretty simple case.
Also Easy Bk Services claim they will get the bk removed from our CR's in just a few months (RED Flag)

Reply:I don't think any bankruptcy petition is easy. I'd be suspicious of sites claiming otherwise.

Reply:I went with DIY4law. An actual attorney looks at the petition but a preparer does the work. I had no problems at all with my no asset Ch 7. FWIW

Can't offer much on the performance of online bk services other than to say I'd be highly skeptical of their ability to do whatever they claim to do.
On the question of BK v credir repair strongly recommend BK.
Credit repair is nothing but hope and promises, nothing is legally binding… so even in the unlikely event one of those companies gets any agreements with the creditors to reduce your obligation it won't make it a non-negative tradeline and the creditor can change their minds.
BK is radical but its legally binding the terms are set and known. I did a 13 (discharged 9/04) and my unsecured creditors just stopped reporting. Poof, gone. A secured creditor reports the BK with no ugly details: closed acct, zero balance. It was the best thing, for me anyway. Had I tried to do it myself with debt repair I'd still be upside down.
Recommend BK removal as a DIY project. I've seen people on here claim to have removed their BK, never attempted it myself, don't think the success rate is very high. You have to attack all tradelines reporting BK then attack the BK itself. If you pay a company to do it (and if they say they can do it in x days/weeks you'll know they're liars) and they can't you'll still be out your money with no recourse.

I purchased and read a book before hand and it wasn't incredibly difficult. You can manage the paperwork if you're willing to put in some time.

Reply:I believe that Amex will automatically kill any apps for either 30 or 60 days after you have been denied. I had the same idea you did, I applied for a credit product and was denied, so I decided to try a charge product which I figured would be easier and got the same message you posted. They did not pull a hard on me for the second app, which I was grateful for – they could have pulled the report THEN denied me for the recent decline, which would have been worse.

Reply:I had apped for "Blue" a few weeks ago – declined. I wanted to try for the Gold charge as there was a change in my EX report.
They cancelled the app before pulling another hard. I'll wait 90 days.

Maybe hit the submit button twice when you were doing the app. You get that message if you apply for a one of their cards and then apply for the same card again before they give you an answer. Last year I apped and was approved for two different Amex's on the same day for both me and my spouse.

Best Answer: Unfortunately you either pay it all upfront or you charge it to a credit card and pay the balance off when you get the bill, but you can't finance without a bank account.

Reply:I wouldn't touch a Dell with a ten-foot pole even if the APR was 0%, but that's just me. Once upon a time, I had a Dell. Need I go any further?

Reply:I've got scores in the 580-600 range (fico not the FKO in my sig) and I've still haven't been able to be approved by Dell or any other major manufacturer. I'm a former computer tech, and I built my own. I'ts the most cost effective way if you can do it.

I had more than one a few years back. I don't believe they limit the # of their cards you can have.

Reply:I just did a 0% for 12 months BT to my AMEX Clear which was BT Fee Free. I know some would be a little scared to do this but I just noticed it went though. Used up just over 50% of my CL – dollarsignr8200 BT. Certainly not a TU pull, but no BT Fees with the AMEX Clear none the less.

Reply: All the terms and conditions look good, but not instant (at least for me). Great find!
Edit: You can transfer balances up to sixty days after opening the account for the 0%, after that it's the purchase APR. This wasn't in their terms, but it's on the FAQ's.

AMEX saved my patootie. [patootie] [costco]


Rolled up in smoke at Costco to get gas. Each pump debit and credit card processing sank.
AMEX network was still working though.
+1 for AMEX.
It was interesting to go as many people and had to turn around. drawn Perhaps 5% of the cars that was in there while I had actually heard people screaming AMEX.
