Procedures regarding immigration law are often very sensitive and
timely. Legislation is under continual evaluation and reform, we
like to keep our clients informed and updated. The following are
some frequently asked questions about immigration processes:
Q: What is a green card?
A: A green card gives an alien (foreign national) the right to
permanently live and work in the United States . The card itself is
a government-issued identification (about the size of and resembles
a driver's license), that serves as proof of permanent resident
status in the U.S. A green card holder, also known as a lawful
permanent resident (LPR), may leave and re-enter the U.S. at any
time and has the opportunity to become a U.S. citizen. Although
referred to as "permanent," a green card may be revoked if the
holder breaks certain laws, does not maintain residence in the
U.S., or travels outside the U.S. for an extended period of
time.
Q: Can my relative sponsor me for a green card?
A: If you have a relative w...

The slow economy in recent times has compelled many employers,
especially those in the Information Technology industry, to lay off
H-1B employees. Unfortunately, a lot of H-1B employees wind up in
troubled waters once they are notified by their employers regarding
the termination of their employment. It is extremely important for
an H-1B visa holder to be in status at all times.
Loss of employment and termination of the H-1B status can result in
the candidate becoming illegal in the United States. Sometimes, a
candidate may be out of status and may accrue unlawful presence.
Unlawful presence occurs when an H-1B candidate continues to reside
in the United States after the expiration of the I-94 document and
has no other application for relief pending with the USCIS. Once a
person accrues unlawful presence in the United States, he or she
then may be subjected to the three year or ten year bar. For
example, if an H-1B candidate has accrued unlawful presence for
more than 6 months, he or sh...

Secretary of Homeland Security, Janet Napolitano amended an
immigration law providing relief to surviving spouses of U.S.
citizens that passed away before the couple's two year anniversary.
Under immigration law, when a US citizen marries a non-citizen, the
non-citizen is eligible to become a legal permanent resident and
receive a green card. However, the U.S. citizen spouse must file a
petition on behalf of the non-citizen spouse before the two-year
anniversary of the conditional green card as the non-citizen cannot
ordinarily self-petition for legal permanent resident status during
this time.
However, life is extremely unpredictable. A married couple does not
normally think that in two years from their wedding date that one
or both of them may no longer be living. Unfortunately, tragedy
does strike at unexpected moments and a spouse may die.
What will happen to me if my spouse dies before we have celebrated
our two year anniversary?
Although the widow penalty act is in no way shape or f...

A stokes interview happens primarily in marriage based immigration
cases. Very often, U.S. Citizens sponsor their spouses for
Permanent Residence to the United States. Upon submission of the
documents, the USCIS office forwards an interview notice to the
parties to come in for an interview. The interview letter from
Immigration clearly describes the documents which the married
couple has to get to the interview. For example, the interview
letter states that the couple should get all the joint documents to
the interview.
On the date of the interview, the couple has to demonstrate to the
USCIS officer that they intent to establish their life together. To
put it in another way, the couple has to convince the USCIS Officer
that the intent of the marriage is not to circumvent the
immigration laws of the United States. At the interview, the USCIS
Officer makes a determination regarding the validity of the
marriage as well as other issues pertaining to the good moral
character of the beneficia...

On May 11, 2010, USCIS announced that it has redesigned the
Permanent Resident Card-commonly known as the "Green Card." The new
state-of-the-art card incorporates several major new security
features. The redesign was one of the latest ongoing efforts to
prevent and deter immigration fraud. USCIS will now issue the new,
secure format which prevents counterfeiting, and tampering, and
makes it easier to quickly get accurate information.
The new format includes holographic images, laser engraved
fingerprints, and high resolution micro-images which will make the
card nearly impossible to reproduce. There will be a Radio
Frequency Identification (RFID) capability which will allow Customs
and Border Protection officers at ports of entry to read the card
from a distance and compare it immediately with file data. Also, a
preprinted return address will help for an easy return of a lost
card to USCIS.
In addition, to comport with its nickname, the permanent resident
card will actually be colored ...
