Was in the middle of nowhere, trying to decide which dual-sim mobile phone to buy. Very inconveniencing carrying two handsets, so I decided it's time to do something about this. The use of two phones, for two mobile operators was inevitable for my job, otherwise I wouldn't have flinched an eye.
Besides the Chinese phones which I had no interest in, my choice was narrowed to either Samsung or LG, as Nokia is not known for making dual-sim phones. Even if they did, the Korean companies are coming up strongly.
After series of research via the net, I settled for the LG GX500, and for the first time decided to order it via an online store ALLO (www.allo.ua). Have earlier purchased from different online stores, both in Ukraine and beyond. It was usually very okay.
The order went smooth, and after about 48 hrs, I was due to make payment and pick my purchase from their pick-up center. While examining the phone before pick-up, after payment, I realized that the touch-screen was not sensitive to finger touches, and in fact didn't respond at all. However, the side buttons were working, and I even had to give it to the store-guy to have a feel.
Since the side buttons were functional, and it was already evening, closing time for the shop and being fatigued myself, I thought it could be due to the absence of the the sim-cards, and decided to take this home and do that there.
On getting home, after installing the sim cards, the stuff still refused to work, and after about 15 minutes of trying, it suddenly became sensitive. Exploring the handset, it was really a good bargain for its price. Just about everything I needed in a phone was present.
I was awoken the next morning by an incoming call, and when I tried to pick the call, I realized that the screen was again not working. Couldn't pick calls, and couldn't make one either. Then it dawned on me that this stuff is simply defective, and from that moment, I already didn't want that particular handset. It is very annoying to buy a new product only to find out that it is defective. Considering that the LG GX500 had no keyboard, it is as good as being uselss if the touch-screen wasn't functioning, as the phone takes commands via the screen.
Called the Allo store hotline 0 800 300 100 and explained to the online consultant, and she expressed her concern. However, she switched the topic to sending it for repairs in either an LG service center or sending it over to their office for repairs, and if on the occassion it cannot be repaired then and only then will they either send me another one, or refund the money back. TRIED NOT TO BELIEVE MY EARS – BARELY 18 HOURS OF PURCHASE AND SHE'S TALKING ABOUT REPAIRS – UNBELEIVABLE.
She also informed me that this is likely to be a long process, and will be handled in accordance to Ukrainian regulations on consumer protection. So, in essence, I could stay for as much as 20 days without telephone and my money. She so much happended to care about the regulations, but cares less that I made a purchase with my hard-earned money and the product is not working. This didn't seem to matter much, and really surprised me.
I explained to her that all I needed was a new and working telephone, which I have already paid for, and I don't want to go into dissecting the Ukrainian regulations on consumer protection. I expected them to check the phone over what I explained, and if it is the case, then send me another new phone of the same model. If they wanted to repair the defected one, they are free to do so, but I DO NOT WANT TO BUY A BRAND NEW DEFECTIVE AND REFURBISHED TELEPHONE.
She dictated address of where to send the product and in what format to write the application. She suggested I should write that I'm sending the phone for diagnostics and repairs, which I refused to accept such format.
I told her I will write for a replacement for the defected phone or a refund of my money, which I already did and sent to them on 01/07/2011, and below is a copy of the letter. I captured images of the product and a video footage of the non-functional screen. Should the need arise, I will also publish it here.

I made it clear that I DON'T WANT A REPAIRED NEW PHONE. I WANT A BRAND NEW PHONE, FULLY FUNCTIONAL OR A REFUND OF MY MONEY.

Haven't heard from Allo Internet store after sending back the defective LG GX500 telephone purchased from them. Decided to call their hot-line, and they referred me to someone else by name Constantin, telephone: 0676183321.
Called on Constantin, and he confirmed to have received the package only today, 05/07/2011, and said he will get back to me himself. Waiting to hear from him.

I got a call from the customer service department of Allo asking for my bank details to transfer the payment refund into my account. I told them that I wanted a telephone, just a functional and new one. However, if they are not able to provide such, then I will opt for a full refund. Two days later, I got a another call with information on how to claim my new telephone, and the very next day, I was already playing with my new toy. Although they failed to send apologies for the additional problem I had to go through just to receive my legitimate purchase, I was still glad that it ended amicably, and my new toy is currently rendering it's service fully.
THE LESSON HERE IS THAT DIFFERENT PROBLEMS MIGHT REQUIRE UNIQUE AND TACTICAL SOLUTIONS. This blog post helped a lot to get the company do the right thing, as they know it could potentially damage their reputation, because I still have videos and images of the non-functional phone, which I did not eventually publish. However, if they have failed to act accordingly, I would have published them, and it could have really affected their business and reputation. I also made it known to them that I would go that far.

The Chairman of the Independent National Electoral Commission,
Prof. Attahiru Jega, has sent a letter of protest to the Chief
Justice of Nigeria, Justice Aloysius Katsina-Alu, over the abuse of
ex-parte orders by judges.
Jega had on Monday expressed frustration at the 150 cases against
it, arising from the lists of candidates forwarded by political
parties for the April elections. He said the rash of court orders
were being viewed by many Nigerians as a deliberate ploy to
sabotage the democratic process.
A copy of Jega’s February 17, 2011 letter entitled, ‘Abuse of
ex-parte orders by courts of co-ordinate jurisdiction’ dated, was
obtained by our correspondent in Abuja on Tuesday.
He implored the CJN to use his position as the chairman of the
National Judicial Council to address the issue.
The letter reads, “Permit me to bring to your notice, the emerging
trend in the political process where ex-parte orders are granted at
the drop of a hat by judges, particularly at the State and Federal
High Courts. This is more worrisome where nearly all the orders
contradict one another.
“Without prejudice to the necessity or otherwise of such orders,
the insinuation that it is a ploy to sabotage the democratic
process needs to be seriously addressed. The growing feeling that
there exists a deliberate effort to subvert the framework of our
bid to deliver credible election in 2011 with grave consequences to
our national stability and cohesion must be assuaged.
“While I empathise with the challenges the political class have to
contend with on account of the recent amendments to the Electoral
Act, the need to manage public perceptions with regards to how the
judiciary manages individual and public interests cannot be
overemphasised.
“At this point of our national development, free, fair and credible
elections have become of crucial national interest; and the
progress and sustenance of our nation in this regard is predicated
on the ability of the commission and all stakeholders, the
judiciary inclusive, to surmount pre-emptive obstructions
militating against this aspiration of Nigerians.”
The INEC chairman added that since January 31, when parties
submitted the forms of their candidates, the commission had
received a total of 132 court summons. Out of this figure, he said
70 were ex-parte orders issued by courts.
Jega added, “Having sworn to uphold the law, both substantive and
adjectival in the discharge of our constitutional responsibilities,
the above statistics clearly indicate an intention to fetter this
obligation. The idea that unless the political process is derailed,
then private and primordial interests cannot be met is an ever
present danger.
“The role of the judiciary, therefore, as an institution for the
protection of our collective aspirations requires much more serious
consideration.”
He stressed the need for the CJN to caution judges against granting
“frivolous ex-parte orders, in order to protect the integrity of
the electoral process.” He also said INEC should be put on notice
and given an opportunity to state its case before the granting of
such orders.
He also urged the CJN to ensure that lawyers applying for such ex-parte orders provide an undertaking that they would not raise any subsisting order on the same matter from another court.
