Need Help Fast! We Need To Sell Our House Before It's Sheriff's Sale Date!?Our house has been in Foreclosure for months and there has been nothing we've been able to do to Stop it. We've called the mortgage company time and time again trying our best to work anything out, and all they have told us is that we need to come up with over $15,000 by May 22nd (which is in about a week) to give them in one lump sum. That's impossible. So when they told us this (about a month ago) we decided to look into selling the house to one of our friends before the sheriff's sale date, which is June 7th. Is this possible? He's more than willing to buy our house for it's complete estimated value and wants to make an offer. Parents Taking Advantage Of Their Grown Children, How To Get It To Stop?Father died at age 12, I am the youngest of three children at age 35. I am married and my husband and I have been together for 13 yrs. My mother recently lost her house due to foreclosure, and wants to move into my home. They are both unemployed and lazy and do not take a proactive role in their lives whatsoever. My brother and sister have always had everything provided to them, but with me it was always different and she always asked money from me since I was a kid. I have 2500 sq. ft. home and my husband and I decided to build and in-law for them. She agree as well as my stepfather to get jobs, and my husband and I have only asked for them to pay the differential expenses of what it will add on to a large home in Fairfield County. Would The Subprime Crisis Happen If Property Supply Did Not Grow So Fast Or High?so subprime was doing well and houses were built, right? and then interest ates went up for monthly payments or something along the lines, and basically the monthly payments shot up. that and other things eventually led many subprime borrowers to Stop their payments and foreclose their houses? so investors thought property values always rise. subprimes were traded on the market. but the value of the houses went down because too many houses, too many foreclosures, and houses lost value as compared to initial valuation. its stocks are perceived to be worth less. confidence goes down and people sell sell sell. yes? well, i don't understand why sell sell sell would lead a company to collapse, but that's a different question. if it does, then my question is, would the subprime still happen if the houses taken back by the lending institutions did not lose value? if the initial loan was $100,000, and thus far the borrower has returned $10,000 (whether into principal or interest), and then he defaults and the lending institution takes the house and finds the house is worth $90,000 and manages to sell it at that price, then what is the problem other than no profit being made? i don't quite understand. if the subprime practise had gone on as it did, even with loans being given to people to default years later, but if property prices did not fall but at least grew with the rate of inflation, would a crisis have occured? perhaps, i am not sure why the crisis occured. my understanding so far is that 1) subprime loans resulted in a lot of defaults, 2) property prices dropped, 3) people lose confidence. but if number 2 did not happen, would the whole chain of events not occur? Question About A Mortgage Company Foreclosing On Property...?About three years ago we bought a new home. We were assured by the real estate agent that our old home would sell right away. Three real estate agents and almost three years later the house is still not sold. We quit making payments in October of last year because we could no longer afford two house payments and were falling behind on our current home. We WANTED the bank to take it!! In March 08 they filed for foreclosure, in May they filed for a default judgment. Two days ago I received a letter in the mail from the courts saying the plaintiff dismissed the case WITH prejudice. I called the mortgage company and they gave me the run around saying they could not find my mortgage. Finally after holding ten times for a total of over an hour the woman said she found it. She became very nasty because the loan was so overdue. I asked her why the Foreclosure was stopped first she said it was to save my credit....come on. Then she said that they were not going to sell my house for me and that the area's property values were rapidly declining and they would not get enough money for the amount I owe. She then told me that I had better do something Fast (such as a short sale or make payments) because they are going to start garnishing wages. My questions are: How can they garnish if they dismissed their own case with prejudice? Doesn't that mean they cannot sue again? Why on earth would they dismiss with prejudice unless they had lost the original loan documents or something? Can they really garnish without taking the house, or is the house collateral that they have to use to cover some or all of the debt? Please help!! I plan on seeing an attorney Friday, but I cannot Stop thinking about this mess. Thank you for your response bull. We did rent the house from April '05 to Feb '06, they damaged the house so badly we spent five months remodeling. We swore we would never do that again lol. Have You Ever Tried Piggybacking Your Credit?My husband and I are just a few points on our credit report away from getting a house that his Grandfather built and was sold a few years ago outside of the family and now is a foreclosure. We have to move Fast so we heard about piggybacking and his mother is adding him as an authorized user on her credit card with a very long history and excellent payments. (her score is 800+) My Question is if anyone has tried this and how many points did your score raise? Just for an FYI we have NO late payments on our credit report. We are just building our credit and it is just taking too long. So if you don't have nothing nice to say don't say anything at all. What Happens When You Quit Paying On A Bankruptcy In Ca?I have my house and some old credit cards tied up in a bankruptcy, but the payments are too great, they were just raised by the trustee $350 and it put us over the edge. How long can I live in my home if I Stop making payments? Will the bank be able to foreclose faster? How long will the Foreclosure take? I know that I messed up.... I just want to know what my options are.. Can I refi my home 14 months after a bankruptcy? Should I talk to the bank about a short sale or is my only option just to walk away?? Is it better then to ask for my BK to be converted into a ch 7 then it is to just walk away and let them foreclose. I am sure they are both horrible for my credit, but is one slightly better than the other? I was unaware that we could discuss this with the trustee. I thought that what ever he choose was a done deal. Our payments went up because they decided that we needed to add an escrow account to our mortgage, but from what I understand from the paperwork on our escrow account, because we are in BK and we don't normally have an escrow account with our mortgage, we are paying more than we normally would. It was really strange.. after 10 months of payments, I got a letter stating that the trustees office is imposing an escrow account onto our mortgage and our new payment would be $350 higher effectice immediately. The letter was received on the 12th our payment was due on the 25th we didn't even have a 30 day grace period to adjust. I have heard that our trustee is actually really difficult and that he often does his oun thing and some of his numbers often cannot be justified. Being Taken To Court....?This is a weird situation here and I am going to try to be as short but as detailed as possible for anyone who might be able to assist us here. Back in 10/2008 my husband was diagnosed with cancer. We were living in Texas at the time. His mother flew from Florida to Texas twice to help us out while he was going through Chemo. In Febuary we took a vacation to FL to visit his mother and step father. There was a three week break before his last chemo threatment and he was feeling pretty good, so we decided why not. The purpose of this trip was not only to visit and refresh ourselves, but to look at houses that they had found, they wanted us to move to Florida with the kids when his cancer was gone. We found the house we wanted on this trip and made an offer. Then we returned to Texas. In March we were told that all was a go on the house and we're given a closing date. We loaded a moving truck and closed on the day we arrived in Florida. The house was paid for in cash (well, wire transfer) and is in my name and my husbands name. It was a gift from the mother and step father to us. My husband had been unemployed sense December.... Trouble started right away about furniture. The mother didn't like some of our stuff and bought other stuff without consulting us. Trouble also came about the way we set up the bedrooms. I had wanted a four bedroom so all the kids would have their own room, after we moved in and the mother visited, she had a fit that I had the baby in her own room rather then in with her big sister. I told her I wanted it this way, that I liked the kids being where they were....she wanted it to be a guest room. Anyways, it went on from there. Non Stop bickering because we wouldn't do things 'their' way. End of May comes and we get papers in the mail saying that we need to sign this promissory note. The step father now wants us to pay him back for this house. We dont sign. Fast forward to now. We are being brought to court for foreclosure. I have contacted several attorney in my area but have yet to hear from anyone yet. I have researched on the Net and have found nothing to help me. Any advice?
